The real estate industry is arguing again.

This time, it is about private listings, MLS cooperation, appraisal data, consumer access and who controls the information underneath the housing market.

Those issues matter.

In a recent Inman op-ed, eXp Realty CEO Leo Pareja warned that fragmented listing and sales data could weaken the comparable-sales system appraisers, lenders and the broader mortgage market depend on. His argument is straightforward: if you want the benefits of the cooperative marketplace, you need to contribute accurate information to it.

Agents should pay attention to that debate.

But they should not build a business that depends on correctly predicting how it ends.

Your job is not to guess the next rule change. Your job is to build a business strong enough to win under any set of rules.

The Industry Will Keep Moving the Goalposts

Think about how much has changed in just the past several years:

  • Commission rules have changed.

  • Buyer representation has changed.

  • Portals have changed their models.

  • Brokerages are fighting over public and private inventory.

  • AI is changing how consumers find agents.

  • Regulators continue examining industry practices.

  • Mortgage rates continue moving buyer affordability.

As of July 23, 2026, the average 30-year fixed mortgage rate was 6.58 percent. Existing-home sales were running at an annualized pace of roughly 4.09 million in June, with a national median price of $440,600. This is not an effortless market where simply possessing a license guarantees transactions.

And that is exactly why your fundamentals matter more.

You cannot control:

  • The Federal Reserve.

  • Mortgage rates.

  • DOJ decisions.

  • NAR policies.

  • Portal strategy.

  • Private-listing rules.

  • Your competitors’ behavior.

You can control how many people you speak with, how consistently you follow up and how effectively you stay visible.

That is where your business should be built.

Pillar One: Proactive Prospecting

Most agents are still operating reactively.

They wait for:

  • A Zillow lead.

  • An Instagram message.

  • A past client to remember them.

  • An open-house visitor.

  • A portal notification.

  • Their brokerage to hand them an opportunity.

That is not a business strategy.

That is dependency.

A market-proof business begins with proactive conversations.

Every day, you should be reaching out to people who may need help now, later or sooner than they currently realize.

Your core prospecting lanes should include:

  • Expired listings.

  • Withdrawn and canceled listings.

  • For-sale-by-owner opportunities.

  • Homeowners in neighborhoods where you have buyers.

  • Past clients.

  • Sphere contacts.

  • Old internet leads.

  • Homeowners approaching major life transitions.

Use this simple opener:

“Hi, this is Dan. I’m reaching out because the market has changed significantly, and I’m helping several homeowners understand what their property could realistically sell for today. Have you considered making a move in the next 12 months?”

Your goal is not to force an appointment.

Your goal is to uncover motivation, timing and problems you can solve.

When your pipeline comes from conversations you initiate, no portal, policy or competitor can shut off your business.

Pillar Two: Own the Relationship With Your Database

Many agents claim to have a database.

What they actually have is a list of names buried inside a CRM.

A database only has value when the people inside it remember you, trust you and understand exactly how you can help.

You should not be contacting your sphere only when you need a referral.

You need a consistent top-of-mind system.

Use the 4-2-1 Database Framework:

Every month:

  • 4 helpful touches: market updates, local information, homeowner advice or useful content.

  • 2 personal contacts: calls, texts, voice notes or direct messages.

  • 1 direct real estate conversation: ask about plans, timing or someone they know who may need help.

Try this message:

“Hey Sarah, I was thinking about you and wanted to check in. I’m doing a midyear review with past clients and helping them understand how their equity and buying power have changed. Are you still thinking you’ll stay put for the next few years?”

That is personal.

It is relevant.

And it creates a natural business conversation without sounding desperate.

Your SOI should not merely know that you are in real estate.

They should know:

  • Who you help.

  • Where you work.

  • What problems you solve.

  • Why they should introduce you.

  • How to contact you immediately.

Pillar Three: Use AI to Multiply Execution

AI will not save an agent who refuses to prospect.

But it can make a disciplined agent dramatically more productive.

The wrong approach is spending hours experimenting with tools while avoiding the phone.

The right approach is using AI to remove friction around your highest-value activities.

Use AI to:

  • Draft personalized follow-up messages.

  • Summarize call notes and identify next actions.

  • Create neighborhood market updates.

  • Repurpose one video into emails, posts and scripts.

  • Categorize leads by urgency and motivation.

  • Prepare listing presentations.

  • Create objection-handling practice scenarios.

  • Build automated nurture sequences.

Here is a practical workflow:

After every prospecting block:

  1. Enter your notes into your CRM.

  2. Use AI to summarize each lead’s motivation, timeline and objections.

  3. Generate a personalized follow-up message.

  4. Schedule the next contact before leaving the record.

  5. Add the lead to the correct nurture campaign.

Your operating rule should be simple:

Automate the administration. Never automate away the relationship.

The agents who win will not be the ones who use the most AI tools.

They will be the ones who use AI to create more human conversations.

Production Creates Income. Ownership Creates Freedom.

Prospecting, follow-up and AI can help you build a durable sales business.

But even a durable sales business has a limitation:

If every dollar depends on another transaction, you still have to keep running.

That is why successful agents eventually need a second layer.

Revenue share allows you to turn your knowledge, relationships and leadership into a recurring asset by helping other agents grow.

This is not about abandoning production.

It is about adding leverage to production.

Your weekly revenue-share plan can be simple:

  • Have five meaningful agent conversations.

  • Invite two agents to review your platform.

  • Help one agent solve a real business problem.

  • Share one piece of content aimed at agents.

  • Follow up consistently without pressure.

Use this conversation starter:

“You’re already producing, so I’m not calling to tell you how to sell houses. I’m curious whether your current brokerage is helping you build anything beyond your next commission check.”

That opens a much more important discussion.

☐ Call 25 database contacts.

☐ Schedule every lead’s next follow-up before ending the conversation.

☐ Install one AI workflow that saves at least 30 minutes per day.

☐ Publish one useful market update for your sphere.

☐ Start five conversations with productive agents.

☐ Calculate what percentage of your income would remain if you stopped selling for 90 days.

☐ Build a plan for recurring income rather than relying entirely on commissions.

Build for What Never Changes

The rules will continue changing.

There will be new lawsuits, new policies, new technology, new competitors and new arguments over who controls the marketplace.

Let the industry debate them.

You should build around what never changes:

People move.

People need advice.

Relationships create opportunities.

Conversations create appointments.

Follow-up creates closings.

Leadership creates leverage.

Build that business, and you will not need perfect market conditions.
